Welcome to Too Budgies. By placing an order through our website, you agree to the following Terms of Service. Please review these terms carefully before placing your order.

Made-to-Order & Personalized Products

Too Budgies specializes in custom and personalized made-to-order diaper cakes and gifts. Because our products are created individually, the final product may have slight variations from photographs or examples shown on our website.

Product availability may also vary. If a particular item, brand, color, pattern, or decorative element shown in an example is unavailable, a comparable substitution may be made. For custom orders, any significant substitutions or changes will be communicated to the customer whenever reasonably possible.

Custom Orders & Deposits

A 50% deposit is required when placing a custom order. This deposit allows us to begin purchasing materials, planning, and creating your gift.

The remaining balance is due after the completed product has been presented to you for final approval and before the order is shipped.

Photos of the completed gift will be provided to the purchaser for final approval. Once final approval has been given, the remaining balance becomes due and the order will be prepared for shipment.

Order Changes

Because each gift is made to order, please contact Too Budgies as soon as possible if you need to make a change to your order.

We will make every reasonable effort to accommodate requested changes, but changes cannot be guaranteed once materials have been purchased or work on the order has begun. Additional charges may apply if a requested change requires additional materials or significant additional work.

Cancellations

Orders should be canceled at least 7 days before the scheduled delivery date.

For cancellations made 7 or more days before the scheduled delivery date, any refund will take into consideration materials already purchased or work already completed for the custom order.

Orders canceled within 7 days of the scheduled delivery date may be partially refundable or non-refundable depending on how much work has already been completed and what materials have been purchased for your gift.

Because our products are custom and made to order, we reserve the right to retain all or a portion of the deposit to cover materials, supplies, and work already performed prior to cancellation.

Returns & Refunds

Because Too Budgies products are custom, personalized, and made to order, we do not accept returns.

However, we want you to be happy with your purchase. If there is a problem with your order, please contact us promptly. Concerns will be reviewed on a case-by-case basis, and we will make reasonable efforts to resolve legitimate issues.

Approval of the final product photographs confirms your acceptance of the design and appearance of the gift prior to shipment.

Shipping

Too Budgies currently ships within the United States only.

Customers are responsible for providing a complete and accurate shipping address. Too Budgies is not responsible for delays or delivery problems resulting from incorrect or incomplete shipping information provided by the customer.

Once an order has been transferred to the shipping carrier, delivery times may be affected by circumstances outside of our control. While we will make reasonable efforts to assist with shipping issues, we cannot guarantee carrier delivery dates.

Delivery Dates

If your order is needed for a particular event or date, please provide the requested delivery date when placing your order.

We will make reasonable efforts to have your order arrive by the requested date. However, shipping carrier delays and other circumstances outside of our control may affect actual delivery.

Product Use

Our diaper cakes may contain diapers, baby products, ribbons, decorations, packaging materials, and other components. They are intended as gifts and decorative arrangements and are not toys.

Please remove all ribbons, pins, fasteners, packaging, decorative materials, and other non-baby items before using any of the individual products contained in the gift. Adult supervision is required when unpacking or disassembling the arrangement.

Pricing & Payment

All prices are listed in U.S. dollars. Applicable sales tax and shipping charges will be calculated as appropriate during the ordering process.

Too Budgies reserves the right to correct pricing errors or inaccuracies. If an error affects an order that has already been placed, we will contact the customer before proceeding.

Intellectual Property

All original photographs, product designs, website content, text, graphics, logos, and branding appearing on the Too Budgies website are the property of Too Budgies unless otherwise noted and may not be reproduced or used for commercial purposes without permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Too Budgies will not be liable for indirect, incidental, or consequential damages arising from the purchase, use, or misuse of our products or use of our website.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited under applicable law.

Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to its conflict-of-law principles.

Changes to These Terms

Too Budgies may update these Terms of Service from time to time. Any changes will be posted on this website with an updated revision date.
